Statement: UKACC Calls for Reform of the Misconduct in Public Office offence: Robust Accountability Matters

Thursday 19 February 2026 – Today's arrest of Andrew Mountbatten Windsor is the second high-profile investigation under the Misconduct in Public Office offence in the last few weeks alone. It is highly welcome to see this offence being used to address alleged misconduct at such high levels of public office, to bring accountability to those who are alleged to abuse their positions of power.

Misconduct in Public Office is an incredibly serious offence. However, to date, just four individuals who have held a senior position have been successfully prosecuted under the offence – none of them political figures. 

It is critical that our criminal law is fit for purpose to hold those who engage in abuse to account. As opportunities present themselves to strengthen these laws, we urge the government to act swiftly and close existing loopholes. 

Any proven abuse of a senior public role for private ends, financial or otherwise, is corruption that erodes public trust in our institutions. It would be a travesty of justice if weaknesses in the law result in difficulties in bringing successful prosecutions. Victims of exploitation of all kinds must receive the justice they deserve.
